The Trump administration has introduced enhanced vetting measures for H-1B visa applicants, a move that could significantly impact foreign workers seeking employment in the United States. According to a State Department cable obtained by multiple sources, the new policy requires thorough scrutiny of resumes, employment histories, and social media activity, particularly for applicants involved in areas related to content moderation, misinformation, disinformation, or other activities linked to censorship.
H-1B visas, highly sought after by US tech companies, allow American employers to hire foreign professionals in specialty fields such as IT, engineering, and scientific research. India and China have historically supplied a large portion of these skilled workers, making the policy particularly relevant for applicants from these countries. The enhanced vetting applies to both new applicants and those reapplying for H-1B visas, and will also extend to family members accompanying the visa holders.
The State Department’s directive instructs consular officers to investigate whether applicants have participated in or supported censorship of protected speech in the United States. If evidence of such activities is found, applicants could be deemed ineligible under specific articles of the Immigration and Nationality Act. Officials highlighted that H-1B workers, particularly those in technology and social media companies, may be subject to stricter reviews due to the potential of involvement in content regulation or suppression.
This new policy has not been publicly reported prior to the release of the State Department cable. While the vetting will affect all visa applicants, H-1B holders face heightened scrutiny because of their frequent roles in sectors related to online content, financial services, and technology platforms where speech moderation and compliance issues are common.
The Trump administration has made protecting free speech a key focus of its immigration and foreign policy, emphasizing what it perceives as the stifling of conservative voices on digital platforms. Officials have previously criticized European countries, including Germany, France, and Romania, for alleged suppression of right-wing political perspectives under the guise of countering misinformation.
In recent months, Trump and his allies have also tightened controls on student visa applicants, instructing consular officers to examine social media posts and other online activity for any content hostile toward the United States. The H-1B visa policy is part of a broader effort to regulate immigration more strictly and to ensure that foreign professionals working in the US uphold principles of free expression.
The new vetting guidelines coincide with other measures introduced by the Trump administration, such as higher visa fees for H-1B applicants. Critics of the policy argue that it could create additional barriers for highly skilled foreign workers, while supporters claim it is necessary to protect free speech and prevent censorship-related abuses in the United States.
