The Shah Alam High Court has sentenced welder Chin Ngit Soon to seven years and six months in prison for causing the death of his wife’s alleged boyfriend during a confrontation in Cheras, Malaysia. Justice Noor Hisham Ismail handed down the sentence after Chin pleaded guilty to a reduced charge under Section 304(a) of the Penal Code. The offence concerns causing death in circumstances that do not amount to murder. The court ordered that the sentence be backdated to November 2022, when Chin was arrested. Dispute Began After Alleged Affair

According to the facts presented before the court, Chin had learned several months before the incident that his wife was allegedly having an affair with Wong. Chin reportedly asked his wife to end the relationship. The situation later escalated on November 25, 2022, when he discovered that his wife and Wong were together inside Wong’s vehicle. Chin then took a knife and went to confront Wong. The court heard that his stated intention was to threaten him rather than deliberately kill him. However, the confrontation developed into a physical struggle. During the scuffle, Chin accidentally stabbed Wong. Wong managed to drive his vehicle away from the supermarket car park but stopped approximately 150 metres from the location. Chin then drove him to a private hospital in an attempt to obtain medical assistance.

Wong Taken to Hospital After Stabbing

The private hospital did not admit Wong, following which Chin took him to Hospital Serdang. Medical staff at the government hospital treated Wong for his injuries. Despite receiving medical attention, Wong died approximately nine hours after the stabbing. The sequence of events became an important part of the court's consideration when determining the appropriate sentence. The prosecution's case ultimately proceeded on the reduced charge rather than the original murder allegation. Chin's guilty plea also meant the court did not need to conduct a full trial to determine the facts covered by the amended charge.

Judge Considers Chin's Actions After the Incident

While delivering the sentence, Justice Noor Hisham Ismail said Chin had acted under the influence of emotion and that the fatal incident was not premeditated. The judge noted that the facts presented to the court indicated that the fatal injury occurred during a struggle rather than as part of a planned attack. The court also considered Chin's conduct immediately after Wong was injured. Instead of leaving the scene, Chin took Wong for medical treatment. After the first hospital refused to admit Wong, Chin drove him to Hospital Serdang, where doctors continued treatment. Chin also remained at the emergency department until he was aware that Wong was in a stable condition before leaving.

Original Murder Charge Was Reduced

Chin had originally been charged with murder in connection with Wong's death. The Attorney-General's Chambers subsequently offered a reduced charge under Section 304(a) of the Penal Code. After accepting the amended charge, Chin pleaded guilty before the High Court. The distinction between the original allegation and the final conviction is significant. The court sentenced Chin for the offence to which he pleaded guilty, rather than convicting him of the original murder charge. The seven-year-and-six-month sentence was also backdated to the date of his arrest in November 2022.

Fatal Confrontation Followed Relationship Dispute

The case began with a personal dispute involving Chin, his wife and Wong. What started as a confrontation over an alleged relationship eventually resulted in a fatal injury. The court's findings indicate that Chin had gone to confront Wong after discovering him with his wife, carrying a knife with the stated intention of threatening him. The physical struggle that followed resulted in Wong being stabbed. Although Chin attempted to secure medical assistance after the incident, Wong later died in hospital.
