Air Canada has successfully reversed a ruling from the Canadian Transportation Agency (CTA) that mandated a compensation of $2,079 to a traveler for delayed baggage.
Justice Michael Manson of the Federal Court deemed the 2024 CTA decision to be unreasonable, prompting the case to be reassigned to a new CTA officer for further evaluation.
The complication began in 2022 when Alaa Tannous and his wife experienced luggage delays after flying from Toronto to Vancouver. Air Canada had initially offered them $250, which led to the couple pursuing additional compensation.
The airline contended that the CTA's awarded amount was exorbitant, highlighting that several purchases consisted of luxury items or were made after the luggage's return. Justice Manson concurred, asserting the ruling lacked an adequate justification for linking post-delivery purchases to the delay.
Tannous provided receipts amounting to $3,435, only $1,691.98 of which were for expenses incurred prior to receiving the luggage. The purchases made thereafter included a $433.61 pair of sneakers and a $1,310.40 designer suitcase. Tannous explained that the sneakers were bought without knowledge of the luggage's return, while the suitcase was intended for carrying replacement items home.
The court highlighted the necessity for the new CTA officer to deliver a well-reasoned and logical analysis of the claim, weighing what constitutes reasonable expenses for a baggage delay.
Passengers and airlines currently have the option to appeal CTA decisions to Federal Court to seek clarity on the reasonableness of compensation awards under existing regulations.
