Two Chinese nationals have been taken into custody in connection with the alleged illegal export of Nvidia chips to China, according to the U.S. Justice Department. The men, identified as 43-year-old Fanyue Gong, a Chinese citizen residing in New York, and 58-year-old Benlin Yuan, a Canadian citizen originally from China, are accused of conspiring to smuggle advanced Nvidia H100 and H200 chips out of the United States in violation of federal export controls.
Prosecutors say that both Gong and Yuan worked with employees from a Hong Kong-based logistics firm and a China-based AI technology company to bypass U.S. restrictions on the export of high-performance semiconductors. This comes shortly after former U.S. President Donald Trump approved Nvidia’s export of H200 chips to Beijing, highlighting the sensitive nature of high-tech exports between the U.S. and China.
The Justice Department emphasized that these alleged actions represent a serious breach of U.S. trade and export regulations designed to protect critical technology. The H100 and H200 Nvidia chips, which are highly sought after for artificial intelligence and high-performance computing applications, are subject to strict export controls due to concerns over national security and technological advantage.
Authorities are investigating how the smuggling operation was coordinated and the potential involvement of other parties in the U.S. and abroad. The case underscores the ongoing tensions and regulatory challenges surrounding the transfer of advanced semiconductor technology to China.
U.S. officials have reaffirmed their commitment to enforcing export laws and preventing the unlawful shipment of sensitive technology, signaling that violations of this nature will face rigorous investigation and prosecution.
