A court has decided that former President Trump can stay in charge of California’s National Guard troops in Los Angeles, even though the state’s governor, Gavin Newsom, disagrees and is suing him. This happened after protests broke out in Los Angeles because of immigration raids. Trump sent about 4,000 National Guard soldiers and 700 Marines to the city, saying it was needed to protect federal buildings and officers.
Governor Newsom said Trump’s actions were against the law because the president is supposed to work with the governor before taking over the state’s National Guard. A judge first agreed with Newsom and said Trump had to give control back to California. But now, a group of three judges has paused that decision, so Trump is still in charge of the troops for now while the lawsuit continues.
The court said Trump likely had the power to use the National Guard because there was violence during the protests like people throwing things at officers and damaging buildings. The judges also said that the law does not require the president to get the governor’s permission in this kind of situation.
This is the first time since 1965 that a president has taken control of a state’s National Guard without the governor’s approval. The legal fight is not over yet, and the final decision will come later.
