A significant legal confrontation surrounding conversion therapy escalated on Wednesday when a federal appeals court intervened, blocking Michigan's prohibition of the practice for minors. The court determined that the law infringes upon the First Amendment rights of therapists, mandating that the state refrain from enforcing the ban for the time being. This ruling has elicited strong responses from advocates on both sides and could have ripple effects on similar legislative measures across America.
In a 2-1 decision, the U.S. Court of Appeals for the 6th Circuit concluded that Michigan's ban unjustly restricts the speech of therapists who uphold particular moral or religious principles. The judges expressed that the government cannot endorse only one viewpoint while suppressing another. This ruling issued a preliminary injunction to Catholic Charities of Jackson, Lenawee, and Hillsdale Counties, which had legally contested the ban.
Judge Raymond Kethledge authored the primary opinion, supported by Judge Joan Larsen. They noted that while the law permits counselors to advocate for gender transitions, it prohibits support for contrary views. This selective acceptance, they argued, exemplifies viewpoint discrimination and violates the free speech protections guaranteed by the First Amendment.
Essentially, the judges asserted that the government should not decide which beliefs or counseling methods to sanction. They maintained that even if the state disapproves of conversion therapy, it cannot legally obstruct expressions of ideas simply because they are controversial.
Dissent and Reservations
Not all panel members were in agreement. Judge Rachel Bloomekatz presented a vigorous dissent, advocating that the appeals court should have postponed this ruling until the U.S. Supreme Court resolved a comparable case in Colorado. That pending case holds the potential to offer nationwide clarity on the legal permissibility of states restricting or outright banning conversion therapy for minors. By intervening prematurely, Bloomekatz warned that the 6th Circuit might introduce confusion and preempt the Supreme Court's jurisdiction.
Her dissent underscores that the judicial landscape is still in flux, with the Supreme Court likely poised to influence the fate of conversion therapy laws nationally.
Context of Michigan's Legislation
Michigan's law was enacted in 2023 by a Democrat-led Legislature and signed by Democratic Governor Gretchen Whitmer, who denounced conversion therapy as a "horrific practice." Therapists found conducting conversion therapy on minors risk having their licenses revoked under this regulation.
Over twenty states across the U.S. have adopted similar prohibitions against conversion therapy for minors, aiming to shield youth from practices deemed harmful by numerous health professionals and LGBTQ+ advocacy groups. Research indicates that conversion therapy can exacerbate depression, anxiety, and suicide risks among LGBTQ+ youth.
Defining Conversion Therapy
Conversion therapy involves attempts to alter an individual’s sexual orientation or gender identity, typically from LGBTQ+ to heterosexual or cisgender. Renowned health organizations, including the American Psychological Association, have condemned this approach as both unsafe and ineffective.

Significance Beyond Michigan
The timing of the court’s decision is critical; just two months ago, the U.S. Supreme Court held discussions on a similar case from Colorado involving conversion therapy regulations. The resulting Colorado ruling is anticipated to have substantial influence on the matter nationwide.
Should the Supreme Court decide that states are barred from prohibiting certain counseling types, numerous existing state laws could be overturned. Conversely, if the Supreme Court upholds such bans, Michigan's suspended legislation might be reinstated.
At this juncture, Michigan is unable to put its ban into effect due to the preliminary injunction.
Responses to the Ruling
Reactions from LGBTQ+ advocates ranged from concern to disappointment following the verdict. They contend that the ruling endangers youth and disregards evidence of conversion therapy’s damaging effects. Many organizations express their commitment to continue advocating for protections and resources for LGBTQ+ youth.
