ICC Rejects Duterte's Jurisdiction Challenge, Probe Continues

The International Criminal Court (ICC) judges have rejected the challenge to their jurisdiction raised by the defense concerning the investigation into alleged crimes committed under former Philippine President Rodrigo Duterte’s administration.

The case involves serious accusations related to possible crimes against humanity, linked to the government’s controversial “war on drugs.” Thousands of deaths have been reported during police operations targeting drug suspects. Human rights groups and the ICC have raised concerns about extrajudicial killings and widespread abuses.

Duterte’s legal team argued that the ICC does not have jurisdiction over the case, citing issues related to Philippine sovereignty and the country’s previous withdrawal from the ICC. However, the judges ruled that the investigation could proceed, judging that sufficient legal grounds exist for the ICC to move forward.

The decision is significant as it clears the way for ICC prosecutors to continue gathering evidence and seeking justice for victims of alleged state-sanctioned violence. It also highlights ongoing tensions between international law bodies and national governments that reject external interference.

The Philippines is one of the countries that withdrew from the ICC in 2019, but the court maintained jurisdiction over alleged crimes that occurred before the withdrawal took effect. This ruling confirms that those investigations remain valid.

The ICC’s move has sparked mixed reactions in the Philippines, where Duterte remains a popular figure for some and deeply criticized by others for human rights violations.

This judicial decision represents a critical moment in international efforts to hold leaders accountable for alleged abuses and reinforces the role of the ICC in pursuing justice where national systems may fail.
