Indian Man Detained in US After Perfume Mistaken for Opium

Indian Man Detained in US After Perfume Mistaken for Opium

Post by : Rameen Ariff

Kapil Raghu, an Indian national living in the United States, faced a highly stressful and wrongful detention after police mistakenly believed a perfume bottle in his car contained illegal drugs. Raghu, who is married to an American citizen and is pursuing US citizenship, was stopped by local police in Benton, Arkansas, on May 3, 2025, for a minor traffic violation. During the stop, officers discovered a small perfume bottle labeled “Opium” in his vehicle. Mistaking it for the banned narcotic, the officers arrested him despite his repeated explanations that it was simply a branded fragrance.

Bodycam footage from the incident shows officers accusing Raghu of possessing drugs while he attempted to clarify the misunderstanding. Raghu, who was working as a food delivery driver at the time, insisted he was not doing anything illegal. His wife, Ashley Mays, who arrived at the scene, expressed confusion and concern over why her husband was being taken into custody.

After the initial arrest, Raghu was detained at the Saline County Jail for three days. During this time, authorities discovered an administrative or legal issue related to his visa status, as it had expired. Following this, US Immigration and Customs Enforcement (ICE) took Raghu into custody and transferred him to a federal immigration detention facility in Louisiana, where he remained for nearly 30 days.

Despite the Arkansas State Crime Lab confirming that the substance in the bottle was indeed perfume and not opium, Raghu’s detention created significant complications for his immigration process. The charges against him were officially dropped by a district court judge on May 20, 2025. However, the detention caused his work visa to be revoked, interrupting his path toward permanent residency and citizenship in the US.

Raghu and his family experienced severe emotional distress during this period. His wife described the nights filled with worry and tears, and his stepdaughter reportedly prayed daily for his release. Ashley Mays even considered selling her vehicles and relocating to another country to ensure a safer, happier life for her family.

Currently, Kapil Raghu is working on having his visa status reinstated while recovering from the legal and personal complications caused by the wrongful arrest. The incident underscores the challenges immigrants can face in the United States, especially when minor misunderstandings escalate into serious legal and immigration issues. It also highlights the emotional toll such incidents can have on families while pointing to the need for careful handling of law enforcement and immigration procedures.
