The High Court in Shah Alam has reduced the prison sentence imposed on a businessman convicted of assaulting his wife from 16 years to five years, ruling that the original punishment was extremely excessive considering the circumstances of the case. The court, however, upheld the man's conviction over the incident involving his wife, M Jothi, at their home in Puchong. The case centred on an argument related to a suspected affair and resulted in the businessman physically attacking his wife.

What Happened in the Case?

According to the facts presented before the court, Ashok Kumar confronted Jothi after believing that she was involved in an inappropriate relationship with a former employee. Jothi denied having an affair. She explained that her communication with the former employee was related to personal problems within her marriage. During the confrontation, Ashok became angry and assaulted her. The court heard that he slapped Jothi and also struck her with a belt. The incident later resulted in legal proceedings, with the businessman being prosecuted for causing hurt to his wife.

Why Was the 16-Year Sentence Reduced?

Justice Suriyati Hasimah Hashim said the injuries suffered by Jothi were not serious enough to justify the doubling of the maximum punishment under Section 326A of the Penal Code. Section 326A allows a court to increase the maximum imprisonment available for certain offences under Section 324 when the victim is the offender's spouse or other specified family member. However, the judge stressed that doubling the sentence is a discretionary power rather than an automatic requirement. The High Court therefore concluded that the earlier 16-year jail sentence was disproportionate to the severity of the injuries sustained by the victim.

Conviction Remains in Place

Although the prison term was reduced, the High Court did not overturn Ashok Kumar's conviction. Justice Suriyati rejected the defence's suggestion that Jothi had provoked him into attacking her. The court found that her actions did not justify the physical assault. The judge noted that Ashok had become angry after discovering that Jothi had discussed her marital problems with the former employee. His defence maintained that the assault was a spontaneous response rather than something planned in advance. However, the court did not accept this argument as a reason to remove his criminal responsibility.

Lower Court Had Imposed Multiple Penalties

The Sessions Court had previously sentenced Ashok Kumar to 16 years in prison. In addition to the prison term, the lower court ordered him to receive three strokes of the cane and imposed a RM10,000 fine. The High Court subsequently reviewed the punishment after an appeal was filed. While reducing the prison sentence, Justice Suriyati also set aside the caning order. She explained that the relevant provisions under Sections 324 and 326A of the Penal Code did not provide for caning as part of the punishment in this case.

What the High Court Decided

The final decision means that Ashok Kumar's conviction for assaulting his wife remains valid, but his imprisonment has been substantially reduced. The court's ruling highlights the importance of considering the actual severity of injuries and the circumstances surrounding an offence when determining an appropriate sentence. The judgment also makes clear that a person's anger or feeling of being provoked does not provide legal justification for physically assaulting a spouse. The case has drawn attention because of the significant difference between the original sentence and the punishment imposed by the High Court. The prison term was reduced from 16 years to five years, while the caning punishment was also removed. The ruling does not erase the conviction.
