The Indian government has issued a stringent directive requiring social media platforms to take down unlawful content within three hours of receiving a complaint or notice, state officials and industry sources said on Wednesday. The move is part of an effort to enforce stricter accountability measures for digital platforms and curb harmful material online — but compliance poses significant legal and operational challenges for global technology firms.
Under the revised rules, content that is deemed to violate Indian law — including hate speech, incitement to violence, defamation, and other categories designated in the Information Technology Act and related regulations — must be removed swiftly to protect public order and individual rights, according to government guidelines.
The requirement shrinks the timeline for platforms to respond to government orders from earlier, less prescriptive standards, and could have major implications for how tech companies moderate content in one of the world’s largest internet markets.
The new directive obliges social media companies to act within three hours of being notified by authorities or designated intermediaries that specific content violates Indian law and must be removed.
Officials said the policy applies to content that is “manifestly unlawful,” meaning it clearly breaches statutory provisions, such as:
Incitement to violence
Hate speech or communal provocation
Sexually explicit material involving minors
Defamation that harms an individual’s reputation
Threats to national security or public order
Promotion of terrorism or extremist content
Once notified, a platform must:
Assess the claim
Move to remove or disable access
Inform relevant authorities of compliance actions
Retain records of the content and decision
Failure to act within the specified timeframe could expose platforms to legal liability, including penalties under India’s Information Technology Act and related rules.
Officials declined to elaborate publicly on the full range of sanctions but said the government expects compliance and cooperation from companies operating in India’s digital ecosystem.
India has steadily tightened regulations on digital intermediaries in recent years, aiming to hold platforms more accountable for content hosted on their services.
The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules were introduced in 2021, requiring tech companies to establish grievance redressal mechanisms, appoint compliance officers in India and process government notices within specified timelines.
However, critics said enforcement remained uneven, with platforms slow to act on notices or taking longer to review disputed content. The new three-hour mandate is designed to address those perceived gaps, especially for content that threatens public order or safety.
The government’s approach reflects broader trends in digital regulation, with authorities seeking more oversight over online speech and greater responsiveness from global tech firms that host billions of posts, videos and images daily.
The three-hour take-down rule is grounded in provisions of the Information Technology Act, 2000, and its associated rules on intermediary liability. Under the law, social media intermediaries are protected from liability for content posted by third parties — so long as they act expeditiously on lawful notices to remove or disable access to unlawful material.
The government’s revised guideline clarifies what “expeditiously” means in practice for “manifestly unlawful” content, helping to reduce ambiguity that companies have cited in previous disputes.
Legal experts said that the move places a sharper onus on platforms, but also raises questions about due process and free expression. One key issue is how companies will balance the three-hour window with internal review processes or legal challenges by users whose content is flagged.
Industry sources said that platforms will likely seek clear, written notices and precise legal definitions before acting, to reduce risks of over-removal or arbitrary takedowns that could spark litigation.
Representatives of major social platforms — including global companies with substantial user bases in India — acknowledged the government’s authority to regulate online content, but said that adapting to the three-hour rule will require significant operational changes.
Platforms typically rely on combinations of automated filters and human moderators to process takedown notices, but swift turnaround — especially for complex content categories — can be challenging. Human review is ordinarily considered essential to ensure accuracy and to avoid wrongful removal of lawful expression.
One industry spokesperson, speaking on condition of anonymity, said that while companies respect legal compliance obligations, “three hours is extremely ambitious in practice for content that requires nuanced assessment or involves legal interpretation.”
Some companies are expected to petition for clarifications or exceptions, particularly for content that may not be clearly unlawful at first glance or that raises competing rights concerns.
Legal advocates and civil society groups have expressed mixed reactions. Some welcomed the government’s efforts to address hate speech and incitement online. Others warned that an aggressive take-down regime could disadvantage ordinary users and suppress legitimate speech.
Critics argued that a strict three-hour rule might pressure platforms into removing content without adequate review, potentially stifling dissenting views or artistic expression that fall within lawful boundaries.
Furthermore, the threat of liability could incentivise platforms to err on the side of removal, leading to over-censorship and inconsistent enforcement. This concern is especially acute in politically sensitive contexts or during major national events where online discourse can shape public opinion.
Legal scholars said that while curbing unlawful content is important, mechanisms for appeal, transparency and accountability are equally necessary to ensure that enforcement does not encroach on fundamental rights protected under the Indian Constitution.
One of the core implementation challenges is determining what constitutes “unlawful content.” While hate speech or child exploitation material are generally unambiguous categories, other cases — such as defamation, political criticism, or contextual commentary — require careful analysis.
Platforms must decide whether an incoming notice is valid, whether it has sufficient legal grounding and whether immediate removal is justified. Under the three-hour rule, companies may have limited time to consult legal teams or gather more context.
Where automated tools are used, there is a risk of false positives, where lawful content may be flagged incorrectly. Conversely, false negatives — failing to remove genuinely unlawful content — could expose platforms to legal penalties.
To mitigate these risks, platforms may ramp up investment in larger moderation teams, faster legal review mechanisms and more sophisticated content classification systems tailored to Indian legal norms.
While authorities have not publicly disclosed detailed penalty structures, a government official said platforms that fail to comply with the three-hour mandate could face consequences under the Information Technology Act.
Possible sanctions include financial penalties, suspension of intermediary status and loss of legal immunity for user-generated content — a liability shield that protects platforms if they follow due process on takedown notices.

India’s assertive timetable reflects policy choices to prioritise rapid response to unlawful content, especially where public safety or national order is at stake.
Officials said that social platforms will be expected to comply immediately following the issuance of the directive. Platforms with local presence — such as Indian subsidiaries or local offices — are expected to implement operational changes more rapidly than those relying solely on regional or global headquarters.
Some companies are expected to update notice procedures, enhance legal review workflows and establish dedicated compliance teams focused on Indian law. The scale of change varies by company size and existing infrastructure in India.
Industry insiders said that local partnerships, data localisation and hiring of additional legal and policy personnel in India may accelerate adaptation. At the same time, global platforms may seek clarifications or exceptions in areas where legal definitions remain ambiguous.
Government officials said that the three-hour rule will protect citizens from harmful online activity and strengthen trust in digital platforms. They argued that rapid removal of unlawful content is necessary to prevent harm, reduce misinformation and maintain public order in a digitally connected society.
Supporters of the policy said that while the timeline is ambitious, it signals India’s determination to wield regulatory authority over platforms that have previously operated with limited accountability for content moderation outcomes.
Officials also noted that clear timelines help reduce uncertainty and create expectations that platforms — as major channels of public discourse — must respond swiftly when notified of unlawful material.
