Actor and rapper Will Smith is facing a lawsuit after violinist Brian King Joseph, who performed during Smith’s Based on a True Story 2025 tour, accused him of serious misconduct.
Brian King Joseph has filed legal action against Will Smith and Treyball Studios Management, alleging sexual harassment, retaliation, and wrongful termination. According to the lawsuit, Joseph was first hired in November 2024 to perform at a San Diego concert and was later invited to join Smith’s 2025 tour and contribute to upcoming music projects.
The filing claims that as their professional relationship developed, Will Smith made repeated personal remarks implying a unique emotional connection. One statement cited in the lawsuit reads, “You and I have such a special connection that I don’t have with anyone else.”
The lawsuit highlights an incident said to have occurred in March 2025 during the tour’s Las Vegas stop. Joseph alleges that his hotel room key went missing for several hours before being returned by management staff, who he claims were the only individuals with access to his room.
That night, Joseph says he returned to his hotel room and noticed signs of unauthorized entry. He claims to have found unfamiliar items inside, including wipes, a bottle of HIV medication labeled with another person’s name, and a handwritten note addressed to him. The note reportedly read, “Brian, I’ll be back no later [sic] 5:30, just us,” along with a heart symbol and the name “Stone F.”
Joseph states that he felt threatened by the note and believed someone intended to return to his room without his consent. He says he immediately contacted hotel security, informed representatives connected to the tour, and reported the incident to local authorities using a non-emergency line.
Despite reporting the matter, Joseph alleges that a member of the management team later accused him of lying. He was subsequently informed that his role on the tour had been terminated.
The lawsuit claims the termination caused severe emotional distress, including symptoms of post-traumatic stress disorder, as well as financial and career-related losses. Joseph is seeking damages for sexual harassment, retaliation, and wrongful termination, with compensation to be determined by a jury.
