A collaborative investigation by the Canada Border Services Agency and the Royal Canadian Mounted Police has culminated in the conviction of an Ontario individual for his involvement in illegal employment practices in Alberta's Banff region.
Kevin Kielty admitted guilt in the Alberta Court of Justice on March 2, 2026, facing two counts relating to the unauthorized employment of overseas workers. The court imposed a two-year probation, mandated 50 hours of community service, and levied a fine amounting to $70,000.
The inquiry initiated in June 2022 when multiple law enforcement bodies, including the Ontario Provincial Police and Barrie Police Service, started sharing insights regarding potential immigration infractions. It was revealed that a group of foreign nationals was journeying from Ontario to Alberta to take part in unlawful work within the hospitality industry, especially in Banff National Park's hotels.
Deeper investigations uncovered that approximately 90 foreign laborers from Mexico were working illegally across four resort hotels in both Banff and Jasper regions, allegedly organized by Kielty’s employment agency, One Team.
Kielty faced charges under the Immigration and Refugee Protection Act for employing foreign workers without the necessary authorization and for facilitating their illegal work in Canada. Notably, this case marks his second breach of the same law; he had previously pleaded guilty to similar charges in November 2023, resulting in an 18-month house arrest.
Authorities have underscored the significance of inter-agency cooperation in tackling immigration fraud and safeguarding vulnerable workers. They reiterated that illegal activities can jeopardize the security of foreign workers and compromise the integrity of Canada's immigration framework.
Gary Anandasangaree remarked that this successful conviction illustrates the strength of collaboration between federal and provincial entities in ensuring justice and accountability, commending the investigators’ dedication.
The CBSA has urged the public to report any suspicious immigration-related activities using its Border Watch Line, highlighting the vital role that community vigilance plays in identifying and preventing such violations.
Ultimately, this case signifies a firm message to individuals and businesses that immigration law violations will be treated with seriousness, enforcing strict measures to uphold fairness and safety within the labor market.
