Renowned rapper Eminem, whose real name is Marshall B. Mathers III, has taken legal steps against the Sydney-based beachwear brand Swim Shady, arguing that their name closely resembles his trademarked persona, Slim Shady.
In September, he submitted a petition to the US Patent and Trademark Office aimed at cancelling Swim Shady's trademark. Under US law, the brand must respond to this petition within a week. Eminem’s legal representatives contend that the branding of Swim Shady leads to a misleading connection with the rapper.
In rebuttal, Swim Shady has declared its intentions to defend its intellectual property. The brand, which initially launched as Slim Shade in 2023 and began operations in 2024, specializes in beach-related products like portable umbrellas and swim bags. Earlier this year, Swim Shady secured a US trademark for its name, right before Eminem's petition was filed. Eminem has also opposed the trademark in Australia.
Court documents reveal that Eminem secured the Slim Shady trademark in the US back in 1999, coinciding with the release of his album of the same name. He only sought the Australian trademark in January 2025. Eminem gained fame in 2000 with his Grammy-winning hit single, “The Real Slim Shady,” which solidified the name’s distinctive association with his music career.
Swim Shady presents itself as a local Australian business dedicated to manufacturing stylish and practical sun protection items, with legal representation from the Sydney firm Meyer West IP.
This incident reminds many of a past trademark conflict in Australia involving Katy Perry and a designer named Katie Perry, where the decision favored the Australian designer, creating a narrative of a classic “David versus Goliath” dispute.
