US DOJ Takes Legal Action Against DC for Sewage Disaster

The Department of Justice (DOJ) has launched a federal lawsuit against Washington, DC, and DC Water regarding a substantial sewage leak into the Potomac River.

This legal action stems from the failure of a 72-inch Potomac Interceptor pipeline on January 19, allowing approximately 244 million gallons of untreated sewage to seep into the Potomac near Montgomery County, Maryland. This incident raised alarming questions about the aging infrastructure within the region.

Constructed in the 1960s, the pipeline was reportedly in deteriorating condition. Repair efforts by DC Water had begun on a nearby section in September, yet the failing pipe had long been acknowledged as requiring immediate attention, with severe corrosion identified.

The DOJ's complaint asserts that DC Water neglected proper maintenance and operation of its sewer system, resulting in the spillage of untreated sewage into the river and local environment, thereby threatening public health and ecological safety.

In a separate move, Maryland Attorney General Anthony Brown has filed a lawsuit in Montgomery County Circuit Court, pursuing penalties and damages related to the contamination.

Justice Department officials emphasized that this incident underscores the necessity for municipalities to invest in aging wastewater infrastructure to avert future environmental crises.

Following the incident, DC Water reported prompt action, halting all sewage discharge into the river within 21 days and finalizing emergency repairs in 55 days. The agency stated they are also accelerating rehabilitation efforts on over 2,700 feet of piping in the affected area.

Additionally, the event sparked political controversy, with officials laying blame on local and state authorities. Emergency measures were implemented alongside federal aid to alleviate the situation.

Though the pipeline has resumed operations post-emergency repairs, extensive restoration is still in progress, and the river's monitoring is ongoing.
