A federal judge in the United States has reopened a case scrutinizing whether officials from the Trump administration unlawfully deported numerous Venezuelan men to El Salvador in March. Central to this case is the question of whether they disregarded a court order issued in March that halted the deportations.
U.S. District Judge James Boasberg stated on Wednesday that he will demand sworn testimonies from the involved officials to ascertain if they violated his orders. “It appears that a thorough factual investigation is warranted, and bringing in witnesses to testify under oath seems to be the best way forward,” Judge Boasberg remarked during a recent status conference.
Earlier this year, a three-judge panel from a federal appeals court put a hold on this inquiry. Nevertheless, a larger panel subsequently concluded that Judge Boasberg is permitted to pinpoint the officials responsible and evaluate future actions. The potential criminal contempt proceedings could result in fines or other sanctions for officials found to have breached the court's directives.
Judge Boasberg has requested that the Justice Department outline a plan by November 24 detailing subsequent actions. Attorneys representing the deported Venezuelan men have also been invited to submit their recommendations. The Justice Department contests Boasberg’s authority, maintaining that the administration did not intentionally violate any court orders.
The case revolves around Venezuelan men deported under the uncommon Alien Enemies Act. In April, Judge Boasberg indicated that the Trump administration appeared to be acting “in bad faith” by hastily arranging three deportation flights on March 15 while he was assessing the legality of those deportations. The men were later freed from a prison in El Salvador this summer and returned to Venezuela as part of a U.S.-facilitated prisoner exchange.
