B.C. Premier David Eby Advocates for Overhaul of NCR Framework

In a recent statement, British Columbia Premier David Eby is urging a comprehensive reassessment of Canada's legal policies regarding individuals deemed not criminally responsible due to mental disorders. His appeal follows the conditional release granted to Allan Schoenborn, now known as Ken John Johnson, a case that has garnered significant public attention.

After the ruling, Eby expressed concern that the current legal framework is not adequately supporting families impacted by such decisions, thus exacerbating the trauma for the relatives of victims. He believes that the federal system needs to undergo significant scrutiny to better assist these families.

The conditional discharge awarded to Schoenborn mandates ongoing supervision, requiring him to regularly check in at a psychiatric clinic and return to the Forensic Psychiatric Hospital in Coquitlam, British Columbia, when necessary.

In 2008, Schoenborn was found not criminally responsible for the tragic deaths of his three children: five-year-old Cordon, eight-year-old Max, and ten-year-old Kaitlynne. The court ruled that he suffered from a mental disorder at the time of the crimes, precluding his criminal accountability under Canadian law.

This case exemplifies the complexities surrounding Canada’s NCR laws. Those classified under NCR do not receive traditional convictions but are monitored by review boards that guide their treatment and evaluate public safety risks.

Eby highlighted that the outcome of Schoenborn’s case is distressing to many in British Columbia, asserting that it leaves victims’ families feeling further victimized. He called for necessary adjustments to ensure victims and their families receive enhanced support.

Furthermore, Eby noted that this issue goes beyond a singular incident and raises critical concerns regarding the justice system's equilibrium of public safety, mental health treatment, and victims’ rights. He stressed the importance of a thorough inspection by the federal government regarding the Criminal Code's NCR provisions.

Even with the conditional discharge, Schoenborn will remain under surveillance, with the ability for authorities to reinstate his confinement should the need arise.

Eby plans to bring his concerns to the federal government directly, as any substantial reforms to NCR protocols would necessitate federal intervention.

Discussions on this topic are likely to reignite debates surrounding how Canada's legal and mental health systems manage NCR offenders. Advocates for victims have long argued for a more involved and supportive role for families, while legal professionals emphasize balancing treatment with public safety.

As talks advance, there is an emerging call for the federal government to assess whether the current legal framework satisfactorily addresses the concerns of victims’ families, all while upholding the foundational principles of Canada’s mental health and justice systems. Future adjustments could significantly impact similar cases nationwide.
