The Dubai Multi Commodities Centre (DMCC) and DIFC Courts have unveiled a significant enhancement to their enduring collaboration, aimed at reinforcing Dubai's commercial legal framework and facilitating global enterprises operating within the emirate.
Through a revised Memorandum of Understanding (MoU), over 26,000 companies registered under DMCC can now access a comprehensive array of legal services provided by DIFC Courts. This includes commercial dispute resolution, mediation, wills services, and solutions tailored for the digital economy.
This initiative builds on more than ten years of partnership, designed to enhance legal clarity for international businesses across various sectors, including trade, finance, technology, and digital industries.
H.E. Justice Omar Al Mheiri of the DIFC Courts emphasized that this partnership ensures that businesses can count on English common law frameworks for cross-border contracts, with their judgments recognized globally. He also noted that DMCC members have the opportunity to incorporate DIFC Courts jurisdiction clauses in their international agreements.
DMCC CEO Ahmed Bin Sulayem remarked that this updated MoU solidifies Dubai's role as a top-tier global business destination. He stated that member companies now have access to services such as the Digital Economy Court, mediation center, notary functions, and will planning, thus enabling them to operate with enhanced confidence and legal security.
A standout aspect of the agreement is the DIFC Courts Mediation Service Centre, which offers quicker, cost-effective dispute resolution. Mediation agreements sanctioned by the courts hold the same legal authority as formal rulings.
The partnership also encompasses services aimed at personal and asset protection. The DIFC Courts Wills Service enables non-Muslim residents and business owners to create legally binding wills that protect assets, businesses, and personal interests in the UAE. Furthermore, the newly established Digital Assets Wills Service now accommodates cryptocurrencies and blockchain holdings.
Moreover, the DIFC Courts Digital Economy Court will address complex disputes associated with AI contracts, digital assets, and blockchain transactions, which are increasingly pertinent to DMCC's fintech and innovation landscape.
Both institutions plan to conduct joint workshops, webinars, and awareness initiatives to assist DMCC members in better navigating legal resources and effectively incorporating DIFC Courts options into their business strategies.
The agreement also includes the integration of DIFC Courts services into DMCC’s platforms, coupled with tailored guidance for businesses engaging in international contracts.
