The European Commission has initiated three formal investigations concerning the cloud computing sector within the region, marking a crucial enforcement action since the implementation of the Digital Markets Act (DMA). These investigations are aimed at determining whether Amazon Web Services (AWS) and Microsoft Azure wield enough influence to be classified as gatekeepers under the current competition regulations.
Although these companies do not typically meet the defined thresholds according to the DMA, the Commission believes their significant size and strategic importance in the cloud domain warrant thorough scrutiny. Officials underscored that both firms supply vital infrastructure to countless businesses across the EU, pointing to the necessity of examining their market practices to ensure they do not hinder competition or restrict fair access for smaller competitors.
Investigators will delve into various aspects of cloud service configurations, billing practices, and the bundling of services, aiming to uncover whether particular technical or contractual stipulations pose challenges for competing firms. Additionally, the Commission seeks to evaluate if the existing regulations are robust enough to avert practices that could skew the dynamic cloud market in favor of a select few leading companies.
As per the announcement, all three inquiries are anticipated to wrap up within 12 months, providing regulators with a clearer understanding of the EU's cloud market dynamics and identifying areas necessitating future action.
Microsoft has expressed its willingness to cooperate with the inquiry, while AWS asserted that the cloud environment in Europe remains vibrant and competitive.
