In a significant ruling, a federal judge in the US has declared that President Donald Trump's $100,000 fee for H-1B visas, intended for highly skilled foreign workers, is unlawful. This decision reflects the view that the fee is essentially a tax that Congress never sanctioned, marking a setback for efforts to reform immigration policies.
US District Judge Leo Sorokin made the ruling in Boston on Monday following a lawsuit spearheaded by 20 Democratic state attorneys general. They contended that the steep fee, introduced by Trump in September, drastically raised the financial burden for businesses seeking to employ foreign specialists through the H-1B visa program.
Prior to this fee, employers typically paid fees ranging from $2,000 to $5,000 for visa applications, depending on the specific requirements. Trump's new order escalated the fee to an extraordinary $100,000, posing significant challenges for companies hiring professionals in sectors like technology, healthcare, finance, and engineering.
The H-1B program permits the US to grant 65,000 visas annually, plus an additional 20,000 for advanced degree holders. These visas typically last between three to six years and are crucial for American firms looking to attract skilled overseas talent.
Court documents revealed that demand for H-1B visas plummeted due to the increased costs. By February 15, only 85 payments for the new fee had been processed, indicating a decline in employer interest in the program, according to the administration.
In response, the Trump administration defended this fee as a necessary measure, asserting that it acts as a monetary penalty and that the president holds the authority under federal immigration law to restrict foreign entry. Government attorneys argued that the fee was designed to safeguard American jobs and lessen reliance on foreign labor.
However, Judge Sorokin dismissed this defense, concluding that the $100,000 payment qualifies as a tax rather than a punitive fee, a designation that only Congress has the authority to impose.
Judge Sorokin stated, "The substance and application of the $100,000 payment reveal that it is a tax, irrespective of its nomenclature."
He also referred to a recent Supreme Court judgment that invalidated Trump's expansive tariff measures implemented via emergency powers, noting that similar legal reasoning applies to immigration regulations that do not authorize the president to enact taxes without congressional consent.
Following the ruling, the White House quickly responded. Spokeswoman Taylor Rogers expressed that they believe the ruling can be overturned in the appeals process, asserting Trump's right to control foreign entry for national interest.
The dispute over the H-1B fee seems far from resolved, having already prompted various lawsuits, including one from the US Chamber of Commerce. In a separate ruling in Washington, DC, a judge previously stated that Trump had the legal authority to impose the fee, a decision currently under appeal.
Beyond this fee, the Trump administration has taken additional steps affecting skilled foreign labor, including enhanced background checks for H-1B applicants and proposed alterations to the selection process that would favor better-paid candidates.
This latest court ruling carries significant weight for employers reliant on foreign talent and thousands of professionals aspiring to work in the US. The case is expected to wind its way through higher courts, where the fate of the controversial H-1B fee will ultimately be determined.
