H-1B Visa Renewals Set New Record Despite Trump Rules

H-1B Visa Renewals Set New Record Despite Trump Rules

Post by : Shakul

H-1B visa renewals in the United States are on course to reach an all-time high during the 2026 financial year, despite the Trump administration introducing stricter immigration measures aimed at reshaping the skilled worker programme. Recent approval data suggests that demand for visa extensions remains strong even as policy changes continue to generate uncertainty for foreign professionals.

According to workforce analytics firm LayoffHedge, which analysed data from the US Citizenship and Immigration Services (USCIS), more than 273,000 petitions for continuing H-1B employment had already been approved during the first nine months of fiscal year 2026. With three months still remaining, the total is expected to surpass the previous annual record set in 2025.

Trump Administration Pushes Tougher H-1B Policies

While renewals continue to increase, the Trump administration has attempted to tighten several parts of the H-1B programme. Among the proposed changes was a $100,000 fee on many new H-1B applications submitted for workers outside the United States. However, a federal judge blocked the proposal in June, preventing the rule from taking effect.

The administration has also proposed replacing the current lottery-based H-1B selection system with a wage-based model that would give priority to applicants offered higher salaries. Supporters argue the change would attract highly skilled professionals, while critics believe it could disadvantage smaller employers and international applicants.

Why are H-1B visa renewals increasing despite stricter rules?

Experts say most of the recent approvals involve foreign professionals who are already working legally in the United States. These continuing employment petitions include visa extensions, employer transfers and status amendments, which are not subject to the annual H-1B visa cap. As companies retain experienced skilled workers, renewal numbers have continued rising despite policy changes.

What changes has the Trump administration proposed for H-1B visas?

The Trump administration proposed imposing a $100,000 fee on many new overseas H-1B applications and replacing the existing lottery selection process with a wage-based system that prioritizes higher-paid applicants. Although some proposals have faced legal challenges, the administration continues pursuing broader immigration reforms.

Are record H-1B renewals equal to more foreign workers?

Not necessarily. Immigration experts explain that approval figures represent petitions rather than individual workers. A single H-1B employee may generate multiple petitions over time through renewals, employer changes or job amendments, meaning total approvals should not automatically be interpreted as new workers entering the US labor market.

Experts Urge Careful Interpretation of Data

Immigration researchers have cautioned that the record approval numbers should not be interpreted as the total number of individual H-1B workers. Several experts noted that one employee may submit multiple petitions throughout their employment due to promotions, company transfers or visa extensions.

Policy analysts also point out that a significant portion of the H-1B programme now operates outside the annual visa cap, fueling ongoing debate over immigration reform and labor market regulations in the United States.

H-1B Programme Remains Vital for Skilled Jobs

The H-1B visa programme continues to play a crucial role in helping US employers recruit highly skilled professionals across technology, healthcare, engineering, finance and scientific research sectors. Many companies rely on the programme to address talent shortages and support innovation.

If the current approval trend continues through the remainder of fiscal year 2026, the United States is expected to record the highest number of H-1B continuing employment approvals in the programme's history despite ongoing legal and political debates.

Immigration Debate Continues

The future of the H-1B programme will likely depend on ongoing legal challenges, policy reforms and labor market demands. Government agencies, employers and immigration experts continue monitoring how proposed rule changes may affect international talent, American businesses and the broader economy.
