The U.S. Department of Labor (DOL) has launched over 175 investigations focused on potential abuses related to the H-1B Visa Program, with an intention to safeguard American labor interests while protecting foreign workers from exploitation.
This initiative, known as Project Firewall, commenced after a presidential decree imposed a one-time fee of $100,000 on H-1B visa applications. The program aims to pinpoint and rectify abuses that detrimentally affect both foreign employees and U.S. counterparts.
While definitive findings are yet to be published, preliminary data suggests that more than $15 million in back wages are due to affected workers. Significant issues have emerged, notably instances where highly skilled foreign employees were compensated far below the pay advertised in their job postings. Such practices undermine the integrity of the visa system and pressure American workers to accept lower salaries to compete.
Further investigations showed that many employers did not promptly inform U.S. Citizenship and Immigration Services (USCIS) upon terminating H-1B workers. There were notable delays in reporting, breaching established requirements.
Another issue revolves around the Labor Condition Application (LCA), essential for hiring foreign labor under H-1B and other visa categories. The LCA mandates that employers inform domestic workers prior to hiring foreign personnel. Investigations revealed discrepancies where listed job locations either did not exist or American workers were unaware of the positions vacantly assigned to them.
Additional infractions highlighted included payments lower than those specified in the LCAs, and employers recycling job postings that lacked relevance to the actual descriptions provided in the applications.
Moreover, certain H-1B employees were subjected to "benching"— periods during which they received no pay between assignments, raising serious concerns regarding fair treatment and wage security.
The DOL's proactive investigations signify a commitment to enforcing standards within visa employment practices and ensuring fair labor conditions for all workers in the United States.
