E-Hailing Driver Fined RM101,750 Over Zam-Zam Water Import

An e-hailing driver in Malaysia was fined RM101,750 after being found guilty of illegally importing 5,500 bottles of zam-zam water through West Port, Klang. The Magistrate's Court ruled that the prosecution had successfully proven the charges under the Customs Act 1967.

The accused, Syed Fazillah Syed Assimie, 41, was found to have imported 27,500 litres of zam-zam water in June 2021. The shipment was valued at RM10,175 and was brought into the country without complying with import regulations.

Court Imposes Heavy Fine And Customs Duty

Magistrate Mohd Hirman Ab Raub ordered the accused to pay a fine equivalent to ten times the value of the goods, amounting to RM101,750. Failure to pay the fine could result in a one-year prison sentence.

The court also directed him to pay RM2,035 in customs duty to the Royal Malaysian Customs Department. Additionally, all 5,500 bottles of zam-zam water were ordered to be forfeited to the department.

Why Did Prosecutors Seek A Strong Punishment?

During the hearing, prosecutors argued that illegal imports can affect government tax revenue and weaken import control regulations. They urged the court to impose a deterrent sentence to discourage similar offences in the future.

The defence requested a lighter penalty, citing the accused's irregular income as an e-hailing driver and his family responsibilities. However, the court decided that a significant fine was necessary given the nature of the offence.

Appeal Allowed By The Court

The court granted a stay of execution of the fine pending an appeal to the High Court. Bail was fixed at RM20,000 while the appeal process continues.

Officials said customs regulations are essential to ensuring that imported goods enter the country legally and comply with national trade and safety requirements.

Impact On Import Regulations

The case highlights Malaysia's strict stance on the importation of regulated goods. Authorities continue to monitor imports closely to prevent revenue losses and maintain compliance with customs laws.

Legal experts say the ruling serves as a reminder that even products with religious significance, such as zam-zam water, must be imported according to established regulations and procedures.
