The Ministry of Construction in Vietnam has proposed amendments to the Law on Architecture, focusing on updating the conditions required for practicing architecture. The move is part of a broader effort to modernize the legal system and align it with current development needs.
The draft law aims to improve regulatory frameworks in line with government priorities such as administrative reform, decentralization, and digital transformation. Officials believe that updating the law will help create a more efficient and transparent environment for architectural practice.
Under the current law, architects working independently or holding key roles in organizations must have a valid architectural practice certificate. The proposed amendments retain this requirement but expand the focus to include both conditions and professional capacity.
The Ministry has suggested redefining the criteria to ensure that individuals responsible for architectural design and planning possess the necessary qualifications and expertise. This includes those involved in building design, urban planning, and landscape architecture.
The draft also outlines two possible options regarding the authority to issue and manage architectural practice certificates. One option maintains the current system under provincial authorities, while the other allows both provincial agencies and professional organizations to share this responsibility.
Another key proposal involves improving the management of information related to architects and organizations. The government plans to develop a centralized database that includes all licensed professionals and firms operating in the sector.
This database will be integrated into a national information system, ensuring better monitoring and transparency. Each architect will be assigned a unique identifier, making it easier to track professional credentials and activities.
The reforms also emphasize the use of digital technology in administration and record management. Authorities believe that digital transformation will help streamline procedures and reduce administrative burdens.
Officials have invited public feedback on the draft, highlighting the importance of participation in shaping future policies. The proposed changes are expected to enhance the quality of architectural services and support sustainable development.
