Indian diaspora organizations across the United States have welcomed a federal court ruling that struck down the controversial $100,000 fee imposed on new H-1B visa applications. The decision is being viewed as a major relief for skilled foreign workers and businesses that rely on global talent.
The ruling was delivered by a federal judge in Massachusetts, who determined that the fee introduced by the Trump administration exceeded executive authority and effectively functioned as a tax that had not been approved by Congress. The decision immediately halted the implementation of the costly visa requirement.
Advocacy groups representing Indian professionals and immigrant communities praised the judgment, saying it restores fairness and predictability to the U.S. employment-based immigration system. Khanderao Kand, Chief of Policy and Strategy at the Foundation for India and Indian Diaspora Studies (FIIDS), described the ruling as an important step toward protecting innovation and entrepreneurship. He emphasized that access to global talent remains essential for maintaining America's competitiveness in technology, healthcare, research, and other key sectors.
The H-1B visa program has long been a primary pathway for skilled professionals, particularly from India, to work in the United States. Thousands of Indian engineers, software developers, researchers, and healthcare professionals enter the U.S. workforce each year through the program and contribute significantly to economic growth.
Industry experts noted that the proposed fee could have discouraged employers from hiring international talent and increased recruitment costs dramatically. By striking down the measure, the court has provided relief not only to applicants but also to businesses that depend on specialized skills unavailable in sufficient numbers domestically.
The ruling is expected to have a positive impact on future visa applicants and may influence broader discussions on immigration reform. For now, Indian diaspora groups see the judgment as a significant victory for legal immigration, economic opportunity, and international talent mobility.
