Vietnam has clarified regulations regarding land clearance in construction projects, addressing concerns about whether land acquisition and site preparation can occur before project approval. Authorities have confirmed that approved investment projects serve as the legal basis for carrying out land acquisition, compensation, site clearance, and resettlement activities.
The clarification follows queries raised about the practice of conducting land clearance before official project approval. According to the Ministry of Construction, existing laws clearly define the sequence of project implementation, including preparation, execution, and completion stages.
Under the 2014 Construction Law, project preparation documents such as pre-feasibility and feasibility study reports must include detailed information on land use requirements and site clearance plans. These assessments are essential to ensure the feasibility and effectiveness of the project before approval is granted.
Authorities emphasized that land acquisition and allocation procedures must generally be carried out only after the project has been approved and an investment decision has been issued. This ensures that land-related activities are aligned with officially sanctioned project plans and timelines.
However, the legal framework also allows flexibility in certain cases. Under the Law on Public Investment 2024, competent authorities may decide to separate land clearance, compensation, and resettlement into independent component projects. In such cases, these activities can be implemented separately from the main construction investment project.
This provision enables faster preparation for large-scale or urgent projects, where early land clearance may be necessary to meet development timelines. It also helps improve efficiency in project execution while maintaining compliance with legal requirements.
Overall, the clarification reinforces the importance of following proper procedures in construction investment while allowing specific exceptions to support timely infrastructure development across Vietnam.
