Vietnam has introduced new regulations governing forensic examination in the field of science and technology through a circular issued by the Ministry of Science and Technology. The move aims to strengthen legal processes and ensure proper expertise in handling scientific and technical investigations.
The new regulation defines forensic examination as the assessment of specialized and professional matters within the authority of the Ministry and local governments. It covers a wide range of areas including innovation, digital technology, telecommunications, intellectual property, standards and quality control, and other science related sectors.
According to the circular, individuals appointed as forensic experts must meet strict criteria under the Law on Forensic Expertise. These include having good moral character, holding at least a university degree, and possessing a minimum of five years of relevant professional experience in their field.
In certain cases, individuals who have directly assisted in forensic activities may qualify with at least three years of practical experience. Additionally, all candidates must complete training in legal knowledge and forensic expertise before being considered for appointment.
The regulation also clarifies that educational qualifications must be recognized under Vietnamese law, whether obtained domestically or from foreign institutions. Experience requirements must be directly related to the field of expertise and calculated from the time of employment to the application stage.
Authorities have outlined a clear process for appointing forensic experts and issuing official certification cards. The Ministry of Science and Technology is responsible for appointing experts at the national level, while provincial authorities handle appointments within their jurisdictions.
The procedure includes application review, evaluation by relevant departments, and final approval by the Minister within a defined timeline. Once approved, expert lists will be publicly disclosed on official platforms to ensure transparency and accountability.
Overall, the new circular is expected to improve the quality and credibility of forensic examinations in science and technology, supporting legal processes and enhancing trust in technical investigations across the country.
